This website is a place to look at our work and get in touch. It is not where we do the work. The terms below set out what this site is, what it is not, and the ordinary rules that apply when you use it.

1. Who these terms are with

This website is owned and operated by Lynn White & Associates, Inc., a Tennessee corporation doing business as Mark Lynn Design and Mark Lynn Interiors (“we,” “us,” “our,” or “the firm”). By using this site you agree to these terms. If you do not agree with them, please do not use the site.

2. This site is information, not an offer

Everything on this website — project photographs, descriptions of how we work, studio locations, and hours by appointment — is provided for general information. Nothing on this site is an offer to perform services, a quotation, a fee proposal, or a commitment of availability. Describing a service here does not mean we can take on your project.

3. Nothing here creates a client relationship

Reading this site, emailing us, calling us, or meeting with us does not by itself make you a client of the firm. We take on residential design and interior design work only under a separate written agreement, signed by both of us, that sets out the scope, the fee, the schedule, and the terms of that particular project.

Where anything on this website conflicts with a signed agreement between you and the firm, the signed agreement governs. These terms apply to your use of the website only.

4. Not professional advice

The content on this site is general and is not advice for your property. Do not rely on it in place of professional judgement applied to your specific site, structure, budget, or jurisdiction.

In particular, nothing on this site constitutes structural, civil, geotechnical, mechanical, or other engineering advice; land surveying; a determination of zoning, setback, easement, deed restriction, homeowners association, or historic overlay requirements; a building code or permitting opinion; a construction cost estimate; a real estate appraisal; or legal, tax, or insurance advice. Requirements differ by parcel and by jurisdiction, and they change. Confirm anything that matters with the appropriate licensed professionals and with the authority having jurisdiction over your property.

5. What you send us

Our contact page has a short inquiry form and an email link. The form delivers your message to a customer-relationship service that receives inquiries on our behalf; the email link opens a new message in your own email program, addressed to us, that you write and send yourself. How we handle what you send either way is described in our Privacy Policy.

When you send us anything — a message, a survey, a set of old plans, photographs, an inspiration image — you confirm that you have the right to send it and that doing so does not breach anyone else’s copyright, confidentiality, or privacy. Please do not send us material belonging to another designer or photographer without their permission.

Email is not a secure or guaranteed channel. Messages can be delayed, filtered, or lost. Do not use this website or email for anything time-critical or urgent; call us at (615) 719-7078 instead. An inquiry is not received until we reply to it.

If you send us an unsolicited idea, concept, or suggestion, we are free to use it without obligation, payment, or confidentiality, unless we have agreed otherwise in writing beforehand.

6. Our intellectual property

The design of this website and its contents — text, layout, drawings, plans, renderings, photographs, logos, and the marks Mark Lynn Design and Mark Lynn Interiors — are owned by Lynn White & Associates, Inc. or by the photographers and contributors credited on the site, and are protected by copyright and trademark law.

You may view the site, and print or save pages for your own personal, non-commercial reference. You may not copy, republish, redistribute, sell, or use any part of this site commercially, and you may not use our names, marks, images, or drawings to promote another business, without our written permission. Photographs credited to a photographer or a builder remain the property of that party.

7. Drawings and design documents

Drawings, plans, specifications, and other documents we prepare are instruments of service. Copyright in them stays with the firm. Delivering a set of drawings for one project is not a transfer of ownership and does not give anyone the right to reuse them, build from them a second time, or adapt them for another site. Any right to build from our documents is the right granted in the signed agreement for that project, and no more.

8. Acceptable use

Please do not:

• Scrape, crawl, harvest, or bulk-download the site, or use it to train a machine learning or generative model, without our written permission
• Use our email address or inquiry form to send spam, bulk solicitations, or automated submissions, or circumvent the spam protections on the form
• Attempt to gain unauthorised access to the site, its host, or any connected system, or probe or test its security
• Introduce malware, or interfere with the site’s operation or with anyone else’s use of it
• Frame, mirror, or present the site as your own, or remove any copyright or credit notice
• Use the site for any unlawful purpose or in breach of these terms

We may restrict or block access to the site at any time, without notice, for any of the above.

9. Accuracy and past work

We work to keep this site current, but content may be incomplete, out of date, or contain errors, and we may change or remove any of it without notice. Photographs show completed projects and may include furnishings, finishes, landscaping, and staging that were not part of our scope. Past projects illustrate the kind of work we do; they are not a promise of a comparable result, cost, or schedule on your project.

10. Links to other sites

This site links to and credits other websites and companies. We do not control them and are not responsible for their content, availability, products, or practices. A link is not an endorsement or a warranty.

11. The site is provided as is

To the fullest extent permitted by law, this website and its content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or uninterrupted or error-free operation. We do not warrant that the site will always be available or that it is free of harmful components. This section limits warranties about the website; it does not limit or alter any warranty or standard of care in a signed agreement for design services.

12. Limitation of liability

To the fullest extent permitted by law, neither Lynn White & Associates, Inc. nor its officers, employees, or contractors will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, business interruption, or construction delay or cost, arising out of or connected with your use of this website or your reliance on its content, even if we have been advised that such damages are possible.

Where liability cannot be excluded, our total liability arising out of or connected with this website is limited to one hundred United States dollars (US$100). Again, this section concerns the website. Liability under a signed design agreement is governed by that agreement.

Some jurisdictions do not allow certain exclusions or limitations, so parts of sections 11 and 12 may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Lynn White & Associates, Inc. and its officers, employees, and contractors from any claim, loss, liability, or expense (including reasonable attorneys’ fees) arising out of your misuse of this website, your breach of these terms, or your infringement of another party’s rights through material you send us.

14. Privacy

Our Privacy Policy explains what this site collects and how we handle what you send us. It forms part of these terms.

15. Accessibility

We want this site to be usable by everyone, and we build with accessibility in mind. If you hit a barrier — something a screen reader will not read, contrast that is too low, a control you cannot reach by keyboard — tell us at info@marklynn.com or (615) 719-7078 and we will work to put it right and to get you the information another way.

16. Governing law and venue

These terms are governed by the laws of the State of Tennessee, without regard to its conflict of laws rules. Any dispute arising out of or relating to this website or these terms will be brought exclusively in the state or federal courts located in Davidson County, Tennessee, and you consent to the jurisdiction of those courts. This section applies to the website; dispute resolution for a design project is governed by the signed agreement for that project.

17. Changes to these terms

We may revise these terms at any time. The version posted here is the version in force, and the “Last updated” date shows when it changed. Continuing to use the site after a change means you accept the revised terms.

18. General

If any provision of these terms is found unenforceable, the rest remain in effect and that provision is applied to the extent it can be. Our failure to enforce a provision is not a waiver of it. These terms, with the Privacy Policy, are the entire agreement between you and us regarding this website, and they replace any earlier version. You may not assign them; we may assign them as part of a transfer of the business.
